Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "your") and Musee, a digital agency registered and operating under the laws of the Republic of Albania ("we," "us," or "our"). By accessing or using our website at musee.al, our free tools, or engaging our professional services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our website or services. These Terms apply to all visitors, users, and clients of our website and services. For professional service engagements, a separate service agreement or statement of work will govern the specific terms of that engagement and will take precedence over these Terms where there is a conflict.
Services and Tools
Musee provides professional digital services including but not limited to AI integration, AI automation, machine learning solutions, SEO and AEO, social media management, web development, mobile app development, creative production, and product launch campaigns. We also provide free tools on our website including calculators and diagnostic tools. Professional services are provided under separate engagement agreements that specify scope, deliverables, timelines, and fees. Free tools are provided "as is" for informational and planning purposes only. The results generated by our calculators and audit tools are estimates and should not be relied upon as guaranteed outcomes. We make reasonable efforts to ensure the accuracy of our tools but do not warrant that results will be error-free or that they reflect current market conditions at all times.
Intellectual Property
The content, features, and functionality of our website, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are owned by Musee or our licensors and are protected by Albanian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from our website without our prior written consent. For professional service engagements, intellectual property ownership and licensing terms are governed by the applicable service agreement. Generally, upon full payment, clients receive ownership of custom work product created specifically for them, while Musee retains ownership of pre-existing tools, frameworks, and methodologies used in the delivery of services.
User Responsibilities
When using our website and services, you agree to: provide accurate and complete information in any forms you submit; use our website and tools only for lawful purposes and in accordance with these Terms; not attempt to gain unauthorized access to any part of our website, server, or connected systems; not use automated tools to scrape, crawl, or extract data from our website without our written permission; not transmit any viruses, malware, or other malicious code; not impersonate any person or entity or misrepresent your affiliation with any person or entity; and not use our free tools to generate misleading information or for any fraudulent purpose. We reserve the right to terminate or restrict your access to our website if you violate these Terms.
Limitation of Liability
To the fullest extent permitted by applicable law, Musee and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of our website, tools, or services. Our total liability for any claim arising from or related to our website or free tools shall not exceed the amount you have paid to us in the twelve months preceding the claim, or one hundred euros, whichever is greater. For professional service engagements, liability limitations are specified in the applicable service agreement. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Albanian law.

Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Albania, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall first be submitted to good-faith negotiation between the parties for a period of thirty days. If the dispute cannot be resolved through negotiation, it shall be submitted to the exclusive jurisdiction of the courts of Tirana, Albania. Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights or prevent irreparable harm.

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make material changes, we will update the "Last Updated" date at the top of these Terms and, where appropriate, notify you via email or a prominent notice on our website.
